Notice of privacy practices

This notice is provided on behalf of the licensed clinicians and pharmacies that treat you through the telehealth platform used by Vyro Health (New Marketing Vertical LLC, 30 N Gould St, Ste R, Sheridan, WY 82801, USA), and by Vyro Health to the extent it creates, receives, maintains or transmits protected health information ("PHI") on their behalf as a business associate. "PHI" is information that identifies you and relates to your health, the care you receive or payment for it.

1. Our duties

We are required by law to keep your PHI private, to give you this notice of our legal duties and privacy practices, to follow the terms of the notice currently in effect, and to notify you if a breach of your unsecured PHI occurs.

2. How we may use and disclose your PHI

Without your authorisation

• Treatment. To provide, coordinate and manage your care, for example sharing your intake with the clinician who reviews it and your prescription with the pharmacy that dispenses it.
• Payment. To bill and collect payment for services and medication, and to process refunds.
• Healthcare operations. To run and improve the service, including quality review, training, licensing, auditing and customer support.
• Business associates. To companies that provide services for us under written agreements that require them to protect your PHI, such as hosting, messaging, payment and shipping providers.
• Required by law. When federal, state or local law requires it, including reporting to the FDA or state boards, responding to court orders and subpoenas, and cooperating with health oversight agencies.
• Public health and safety. To prevent or control disease, report adverse events, or prevent a serious threat to your health or safety or that of others.
• Other permitted disclosures. For workers' compensation, law enforcement in limited circumstances, coroners and medical examiners, organ donation, research approved by a privacy board, and specialised government functions, each as permitted by law.

With your written authorisation

Most uses and disclosures of psychotherapy notes, uses and disclosures for marketing, and any sale of PHI require your written authorisation. Other uses not described in this notice will be made only with your authorisation. You may revoke an authorisation in writing at any time, except to the extent we have already acted on it.

Reproductive health care

We will not use or disclose PHI to investigate or impose liability on any person for seeking, obtaining, providing or facilitating lawful reproductive health care, in line with the 2024 HIPAA Privacy Rule amendments, to the extent in effect.

3. Your rights

• Access. You may request a copy of your medical and billing records, including an electronic copy. We may charge a reasonable, cost-based fee. We will respond within 30 days.
• Amendment. You may ask us to correct PHI you believe is incorrect or incomplete. We may deny the request in certain cases and will tell you why in writing.
• Accounting of disclosures. You may request a list of the disclosures of your PHI made in the last six years, other than for treatment, payment, operations and certain other exceptions.
• Restrictions. You may ask us to limit how we use or share your PHI. We are not required to agree, except that we must agree not to share PHI with your health plan for a service you paid for in full out of pocket.
• Confidential communications. You may ask us to contact you in a specific way or at a specific address, and we will accommodate reasonable requests.
• Paper copy. You may request a paper copy of this notice at any time.
• Choose someone to act for you. A person with medical power of attorney or a legal guardian can exercise your rights.

4. Complaints

If you believe your privacy rights have been violated, you may file a complaint with us at support@vyrohealth.com, or with the US Department of Health and Human Services, Office for Civil Rights, at 200 Independence Avenue SW, Washington, DC 20201, by calling 1-877-696-6775, or online at www.hhs.gov/ocr/privacy/hipaa/complaints. We will not retaliate against you for filing a complaint.

5. State law

Where state law gives you greater privacy protection than HIPAA, for example for information about sexual health, we follow the stricter law.

6. Changes to this notice

We may change this notice and make the new notice apply to PHI we already hold. The current notice is always available on this website and its effective date appears at the top.
