These terms of use ("terms") govern your access to and use of the website operated by New Marketing Vertical LLC, 30 N Gould St, Ste R, Sheridan, WY 82801, USA, doing business as Vyro Health ("Vyro Health", "we", "us") and the services made available through it (together, the "services"). By using the services you agree to these terms. If you do not agree, do not use the services.
1. What Vyro Health is, and is not
Vyro Health operates a website that provides information about a compounded prescription treatment for erectile dysfunction and connects you with independent, US-licensed healthcare providers and US-licensed compounding pharmacies through a partner telehealth platform. Vyro Health does not itself practice medicine or pharmacy. Medical decisions, including whether to prescribe and at what dose, are made solely by the licensed clinician who reviews your intake, exercising independent professional judgment. Medications are compounded and dispensed by licensed pharmacies, not by Vyro Health.
Nothing on this website is medical advice, and reading it does not create a clinician-patient relationship. A clinician-patient relationship exists only once a licensed clinician has accepted and reviewed your intake, as described in the telehealth consent.
2. Eligibility
You must be at least 18 years old, located in a US state in which the services are available, and able to form a binding contract to use the services. You must use the services only for yourself. You may not create an intake on behalf of another person.
3. Emergencies
The services are not for emergencies. If you think you are experiencing a medical emergency, call 911 or go to the nearest emergency department. An erection that lasts longer than 4 hours is an emergency.
4. Accurate information
The clinician's decision depends on what you tell them. You agree to provide complete, accurate and current information in the intake and in messages, including all medications, supplements and conditions, and to update it if anything changes. Providing false information can put your health at serious risk and is a breach of these terms.
5. Prescriptions and compounded medication
Completing an intake does not entitle you to a prescription. A clinician may decline to prescribe for any clinical reason. If a clinician declines, you are not charged. If a prescription is issued, the prescribing clinician and the dispensing pharmacy, not Vyro Health, are responsible for the medication and its dispensing.
Compounded medications are not approved or evaluated for safety, effectiveness, or quality by the FDA. Descriptions of the actives on this website reflect the pharmacology of the individual ingredients and are not a promise about how the compounded product will work for you. Individual results may vary.
6. Payment, cancellation and refunds
Prices are shown to you after the clinician's review and before you confirm an order. There is no membership fee. You can cancel future orders at any time. Refunds are governed by the refund policy. Payment is processed by the partner platform or its payment processor under their own terms, which are presented to you at checkout.
7. Your account and communications
You are responsible for keeping your login details confidential and for all activity under your account. By providing an email address or phone number you agree to receive service messages about your intake, prescription and order. Marketing messages require your separate consent and can be stopped at any time using the unsubscribe link or by replying STOP.
8. Acceptable use
You agree not to use the services for any unlawful purpose; to attempt to obtain medication for another person or for resale; to interfere with the operation or security of the website; to scrape, copy or reproduce its content beyond personal, non-commercial use; or to misrepresent your identity or health.
9. Intellectual property
The website, its text, design, graphics, wordmark and the name "The Quattro" as used here are owned by or licensed to Vyro Health and are protected by intellectual property laws. You may not use them without our written permission. Third-party trademarks belong to their owners and are used only for identification.
10. Disclaimers
The services are provided "as is" and "as available". To the fullest extent permitted by law, Vyro Health disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. Vyro Health does not warrant that the website will be uninterrupted or error-free, or that any treatment will produce a particular result. Nothing in these terms limits the professional duties of a licensed clinician or pharmacy to you.
11. Limitation of liability
To the fullest extent permitted by law, Vyro Health and its officers, employees and agents are not liable for indirect, incidental, special, consequential or punitive damages arising from your use of the services, and our total liability for any claim arising from the services is limited to the amount you paid to us in the twelve months before the claim arose. Some states do not allow certain limitations, so some of the above may not apply to you. Nothing in this section limits liability for gross negligence, willful misconduct or any liability that cannot be limited by law.
12. Indemnity
You agree to indemnify Vyro Health against claims, losses and reasonable costs arising from your breach of these terms or from false information you provide.
13. Dispute resolution
These terms are governed by the laws of the State of Wyoming, where New Marketing Vertical LLC is organised, without regard to conflict-of-law rules. Before filing a claim, you agree to contact us and attempt to resolve the dispute informally for at least 30 days. Any arbitration or class-action provisions will be added here only after legal review and will be presented for your acceptance.
14. Changes to these terms
We may update these terms. The date at the top shows when they last changed. Material changes will be announced on the website or by email before they take effect, and your continued use after that date means you accept them.
